I hereby acknowledge that the event entrant named above (hereafter referred to as “I”) has been given access to these conditions, and voluntarily agrees to engage in sporting or wellness and other related activities or events and use of facilities or equipment (hereinafter collectively called the “activities”) that are organised or conducted at the Kalumbila Health and Wellness Centre or the Kansanshi Health and Wellness Centre (the “wellness centres”) or various other locations or facilities (the “locations”); and which activities are organised by the said wellness centres or FQM Trident Limited or Kansanshi Mining PLC.

In consideration for permission to participate in the activities and their benefits, I hereby acknowledge the following:

1.           I am aware that all activities involve risk, and that some are violent contact sports;
2.           I am aware that playing or practicing in any activities may be dangerous and involve both known and unanticipated risks which could result in damage or destruction of property and physical or emotional injury or death of myself or of other persons;
3.           I know, appreciate and understand that the inherent dangers and risks of participating in the activities include, but are not limited to, injuries ranging from minor scrapes, strains, and bruises to significant injuries to the muscular skeletal system, internal organs, oral-dental area, eye injury or loss, concussion, paralysis, and even death, and may result from my own actions, the actions of others, or a combination of both.
4.           I recognize and acknowledge that FQM Trident Limited, Kansanshi Mining PLC, the wellness centres or owners/promoters of other locations do not provide or carry accident or health insurance on the participants in the activities. I also realize that sports injuries can be catastrophic for those without medical coverage.
5.           I understand that such risks cannot be eliminated without compromising the essential qualities of activities. I confirm that I am physically able, emotionally stable, and fully competent to participate in activities and that I, knowingly, and voluntarily assume the risks of participating in such activities.
6.           I understand, and agree that it is my responsibility to know, understand and comply with all rules, regulations and directives established in relation to the activities by FQM Trident Limited, Kansanshi Mining PLC, the wellness centres and other locations. I also undertake to obey the commands of anyone appointed in the capacity of official, traffic control officer or marshal for any activities, and will abide by the rules and regulations of the activities and events.
7.           I affirm that I have and will refrain from being under the influence of alcoholic beverages, drugs or medications that might impair judgment prior to, and during the activities. Further, I affirm that I understand that the possession and influence of unlawful drugs is expressly prohibited and that if strictly by observation, I appear to be under the influence of alcohol or unlawful drugs or emotionally unstable, I shall be denied access to any part of the wellness centres or other locations and will not be allowed to take part in the activities for a discretionary period or at all.

My next of kin, heirs, guardians, executors, administrators, representatives, assigns and I AGREE NOT TO SUE AND HEREBY FULLY RELEASE, FOREVER DISCHARGE, ACQUIT, INDEMNIFY AND HOLD HARMLESS FQM Trident Limited, Kansanshi Mining PLC and/or First Quantum Minerals Ltd (and companies which are ultimately its subsidiaries), their sponsors, trustees, administrators, officers, directors, shareholders, partners, the owners/promoters of the locations, agents, employees, insurers, assigns, and all other related persons, entities, affiliates, predecessors, and successors, from and against any and all claims (whether in law or equity), demands, damages, expenses, causes of action, attachments of property, or liability of any kind whatsoever, that I, my next of kin, heirs, guardians, representatives or assigns may have for property damage, personal injury or death or any consequential loss or damage resulting from me or my guests entering on to the wellness centres or other locations, using their facilities or equipment, or engaging in or observing the activities, even if such claims, demands, damages, expenses, causes of action, attachments of property, or liability result partially or wholly from any act or acts, even any negligent act or omission to act, including negligent or omitted first-aid or rescue operations or procedures.

In acknowledging this agreement, I have carefully read it or have had the contents explained to me and understand that the terms hereof serve as a release and assumption of risk, and that, being fully competent, acknowledge it voluntarily and agree to comply with it. Where I am entering persons on their behalf (for example for team events) I hereby state that I will show this indemnity agreement, as included on my ticket, to all participants, and that I have been authorised by them all to acknowledge this agreement on their behalf. Furthermore, should any of the persons I have entered for any event wish not to accept this agreement, I undertake to inform the event organisers in writing before the start of the event. I further acknowledge and agree that this instrument binds my next of kin, executors, administrators, guardians, representatives, assigns, heirs and I, and those of all persons I have entered.

This agreement shall remain of full force and effect as between the parties for a period of 12 months from date of acknowledgement thereof in relation to all activities in which the parties shall partake in the said 12-month period, unless superseded by any later agreement mutually entered into.

I further agree that my/our photographs obtained at any of the activities can be utilised on social media as well as in any promotional or advertising material without recompense, provided that same shall relate solely and exclusively to the activities in which I have participated.

All payments made in relation to this indemnity form are final and non-refundable.
